Terms and Conditions
1. GENERAL
1.1. The owner of the Reketsport online store (hereinafter the Online Store) is OÜ Top Stop (registry code 11452768), located at Mähe Tee 7, 11912 Tallinn, Estonia.
1.2. These terms of use govern the legal relationships arising between OÜ Top Stop (the Seller) and the person making a purchase (the Buyer) when buying and selling in the Online Store.
1.3. In addition to these terms, the legal relationships arising from the marketing of products via the online store are governed by the laws of the Republic of Estonia.
1.4. The Seller may change the terms of use of the online store and the prices of products and services. Changes will be announced in the online store environment. The terms and prices valid at the time of the transaction shall apply to the transaction.
1.5. The selection of products, prices, and discounts may differ from the selection, prices, and discounts in the Seller's retail stores.
2. PRICE
2.1. Information about the goods is provided in the Online Store directly next to the goods and includes the value-added tax (VAT) of 24% applicable in the Republic of Estonia.
2.2. The prices of the products are indicated next to the products in the Online Store. A fee for the delivery of the goods is added to the price, unless otherwise stated during payment. The delivery fee depends on the Buyer's location and the delivery method. The delivery fee is displayed to the Buyer when placing the order.
2.3. The Online Store has the right to withdraw from the sales transaction and demand the goods back from the Buyer if the price of the goods in the Online Store has been marked significantly below the market price of the goods due to an error.
3. PLACING AN ORDER
3.1. To order goods, the desired products must be added to the shopping cart. To complete the order, the required data fields must be filled in, and a suitable delivery method must be selected.
3.2. It is possible to change products and quantities in the shopping cart and remove products from the shopping cart until the product has been paid for.
3.3. When placing the order, the final price is displayed on the screen, which can be paid via a bank link or other payment solution.
3.4. The contract enters into force upon the receipt of the amount due in the Online Store's bank account.
3.5. The Seller shall send a notice of order confirmation to the Buyer's e-mail address. If the email is not found in the inbox, please check if it has accidentally ended up in the spam folder.
3.6. The Seller has the right to withdraw from the contract if it is not possible to deliver the ordered goods due to the goods being out of stock or for another reason. The Seller shall notify the Buyer of this at the first opportunity and return the entire payment received for the ordered goods (including delivery costs) without delay, but no later than 14 days after sending the notice.
4. PAYMENT
4.1. The Buyer shall pay 100% in advance for purchases made in the Online Store.
4.2. Orders can be paid for via Estonian bank links or on the basis of an invoice.
4.3. Payment takes place outside the online store in a secure environment. The Seller does not have access to the Buyer's bank and credit card details.
4.4. Encrypted data communication with banks ensures the security of the purchaser's personal data and bank details. OÜ Top Stop forwards the information related to payments to the authorized processor Maksekeskus AS.
5. DELIVERY
5.1. The Online Store delivers products to Estonia, Latvia, Lithuania, and Finland.
5.2. Products are delivered according to the method chosen by the Buyer in the Online Store.
5.3. The shipping costs of the goods are borne by the Buyer, and the corresponding price information is displayed next to the shipping method.
5.4. The Seller dispatches orders on all working days, but no later than three working days after the confirmation of the order. In exceptional cases, the Seller has the right to deliver the goods within up to 45 calendar days. The latter includes custom orders.
6. RIGHT OF WITHDRAWAL, RETURNS, AND EXCHANGES
6.1. The Buyer has the right to withdraw from the transaction within 14 calendar days by submitting a written application for withdrawal to the Seller. The application form can be found on the Estonian E-Commerce Association website and must include the following information:
First and last name
Contact phone number and e-mail address
Physical address
Bank account details
Order date and date of receipt of the goods
Name and serial number of the returned product
Invoice number
Reason for return
Please send the returned goods to: Omniva Pirita post office, Omniva parcel machine (Tallinna Pirita Keskus), or SmartPost (Tallinn, Pirita Keskus), addressed to OÜ Top Stop (tel. +372 5555 2220).
In the event of an exchange or return, the shipping costs shall be paid by the customer. OÜ Top Stop will cover the shipping costs only if the error was on our part.
6.2. The withdrawal application must be sent to info@topstop.ee or to the address Mähe Tee 7, 11912 Tallinn, no later than 14 days after receiving the goods. The Seller will confirm receipt of the application.
6.3. The returned product must include all original documentation. All labels and items installed to protect the condition of the goods (e.g., protective films, moisture absorbers, plastic wraps) must be unremoved, provided they do not prevent inspecting the product.
6.4. To exercise the 14-day right of return, the goods must not be used in any way other than what is necessary to establish the nature, characteristics, and functioning of the goods, as would be permitted in a physical store. If the goods show signs of use or wear, the Seller has the right to reduce the refund amount or refuse compensation.
6.5. Return conditions apply to standard-sized products. Custom orders and products tailored to specific requests are non-refundable.
6.6. The Buyer may exchange a product within 14 days if the size is unsuitable. Terms 6.1–6.5 apply to such exchanges.
6.7. If an exchange is not possible due to lack of stock, the Seller will contact the Buyer to offer an alternative solution.
6.8. The Buyer is obligated to return the product within 14 calendar days from the submission of the withdrawal application.
6.9. The Seller does not take responsibility for the product until it has been received. Returning/exchanging is free of charge, except for the return transport costs, which are borne by the Buyer. If the product is defective, the Seller shall bear the return costs.
6.10. The Seller shall refund the amount to the Buyer without delay, but no later than 14 days after receiving the withdrawal application.
6.11. The Seller reserves the right to delay the refund until the item has been received back.
6.12. The Seller has the right to withdraw from the transaction if the price was significantly below the market value due to a technical error.
7. RIGHT TO SUBMIT A CLAIM
7.1. The Seller is liable for any non-compliance or defect that existed at the time of delivery and which appears within two years of delivery. During the first six months, it is presumed that the defect existed at the time of delivery; it is the Seller's obligation to prove otherwise. The Seller is not responsible for defects that arise after delivery.
7.2. Upon discovering a defect, the Buyer must notify the Seller immediately, but no later than within 2 months, via info@topstop.ee or by mail to Mähe Tee 7, 11912 Tallinn.
7.3. In case of a defect, the Buyer has the right to demand repair, replacement, or to return the product at the Seller's expense.
7.4. The Buyer may demand a price reduction or termination of the contract if repair/replacement is not possible, fails, or if the Seller has not rectified the defect within a reasonable time.
8.2. The Seller forwards personal data to the transport service provider in order to deliver the goods.
8.3. The Seller is the chief processor of personal data. The Seller forwards the personal data necessary for making payments to the authorized processor Maksekeskus AS.
8.4. The Online Store sends newsletters and offers to the Buyer's e-mail address only if the Buyer has expressed a wish to receive them by entering their e-mail address on the website and indicating their desire to receive direct mail.
8.5. The Buyer can opt-out of offers and newsletters sent to their e-mail at any time by notifying us via e-mail or by following the instructions in the e-mail containing the offers.
9.2. If the Buyer and the Seller are unable to settle a dispute by agreement, the Buyer may refer the matter to the Consumer Disputes Committee. The Consumer Disputes Committee is competent to resolve disputes arising from the contract concluded between the Buyer and the Seller. The review of the Buyer's complaint by the Committee is free of charge.
9.3. The Buyer may also turn to the European Union Online Dispute Resolution (ODR) platform.
